There are two special circumstances that limit your options: (1) if you were under 25 at the time of the alleged violation and do not wish to set your case for trial, you are required by law to complete a Texas-certified driving safety course; or (2) if you possess a CDL, your case cannot be dismissed by either of the first two options below. Setting your case for trial is only chance for dismissal, absent evidentiary issues or constitutional violations.
This option requires (1) A Certificate of completion of a Texas-certified driver safety course ($25), (2) Court costs paid to Court within 30 days, and (3) A Signed and Notarized Affidavit ($6).
This option provides (1) An often-reduced fine with 30-60 days to pay, and (2) a promise to the Court to refrain from any new citations within a specified time period after payment, usually 90 days.
In situations where financial hardships can be proven to the Court through supported documentation, community service hours may be granted in lieu of payment.
This option may require court appearance(s). Many choose this option in hopes for dismissal without payment because the officer/witness failed to show for trial. If you wish to proceed to trial, additional fees will apply.
